MEMBER ALERT

UFLAC has been informed that decisions are now being made regarding the Vaccination Exemption Requests that many of our members have submitted. It is our understanding that Exemption Denial letters will be emailed directly to individual members if and when their request has been denied.

Please know that any members who plan to appeal an Exemption Denial must do so within 5-business days of the notification date that you receive from Bluestone. We have been informed that any appeal submission made after 5-business days will not be accepted.

The Department has informed UFLAC that any members who receive an Exemption Denial and decide not to appeal will be required to receive their first/final dose of a single-dose vaccine regimen within 14 calendar days of the notification date and their second dose of a dual-dose regimen within 28 days of receiving the first dose.  The Department also notified UFLAC that members who fail to comply with these requirements will be placed off-duty without pay for failure to meet a condition of employment.

NOTICE TO MEMBERS – Vaccine Ordinance

This notice is intended to share information that the UFLAC Board has recently learned regarding the City’s COVID Vaccine Mandate. Since October 20, the Department has implemented the City’s “Last Best and Final” offer. Unfortunately, this has resulted in members who were not compliant to be placed off duty – leave without pay (LW). In many cases, members decided to put in a request for exemption. These members were returned to duty after submitting their requests. We understand that the exemption review process is still ongoing and do not have an estimated time frame to expect a response. Members are encouraged to familiarize themselves with the procedures outlined in the Last Best and Final offer.

In recent weeks UFLAC became aware and has confirmed that once a member is served a “Skelly Packet” and later decides to put in an exemption, that they will remain off duty LW, pending the proposed discipline (Board or Rights). If you are currently off LW and wish to exercise your right to an exemption, UFLAC strongly encourages you to submit your exemption request as soon as possible. If you have any questions about the process, please contact a UFLAC representative to ensure that you are properly informed.

Los Angeles Fire and Police Pensions Update

On April 21st at the Los Angeles Fire and Police Pensions (LAFPP) meeting, with your UFLAC leadership in attendance, the Pension Commission Board voted to increase the maximum retired sworn non-Medicare health subsidy by 4.5%. This vote will raise the unfrozen non-Medicare retiree subsidy from the current maximum of $1,958.82 per month to a maximum of $2,046.97 per month. The increase will become effective on July 1, 2022.

Los Angeles Administrative Code (LAAC) Section 4.1154(e) states in part:

“The Board is authorized to make discretionary changes, on an annual basis beginning in 2006, to the maximum monthly subsidy, so long as no increase exceeds the lesser of a 7% increase or the actuarial assumed rate for medical inflation for pre-65 health benefits established by the Board for the applicable fiscal year.

Per the City Charter, retiree subsidy increases were previously tied to increases for active sworn employees or retired civilians. Because of delays in contract negotiations for active employees, the retiree subsidy increases were often years late, causing a hardship to many retirees. This Charter amendment (passed in March 2005) gave authority to the City Council and Mayor, via ordinance, to determine a more efficient way to provide timely retiree subsidies.”

All bargaining unit members who have been placed out on LW due to the vaccine mandate:

The UFLAC Executive Board would like to remind you that UFLAC will provide to you representation for any Skelly hearing and Board of Rights related to enforcement of the vaccine mandate.  Funding for these procedures comes from UFLAC’s Legal Defense Fund.  In order to seek representation through the Legal Defense Fund, you will need to (1) contact a UFLAC Executive Board member and (2) complete the application.  UFLAC Executive Board members will provide you with the application once you contact them.  The following is contact information for each UFLAC Executive Board member:

 

 

There are time limitations that apply to Skelly and Board of Rights procedures.  It is critical that you contact UFLAC as soon as you receive a Skelly packet.  A Skelly packet is an informational packet that notifies you that the City or the Department intends to discipline you.  Included in the packet should be an explanation of your rights to a hearing and copies of materials that the City/Department is relying upon to support the intended discipline.  If you have any questions, please contact us.

MEMBER ALERT 

Dear Members,

As you know, in October UFLAC filed a complaint with the Employee Relations Board (ERB) challenging the City’s decision to unilaterally implement new terms and conditions of employment related to the vaccine mandate.  The matter was heard this week before a hearing officer appointed by the ERB.  The hearing concluded yesterday and the parties will prepare and submit post-hearing briefs and then the hearing officer will issue a written decision.  All of this may take several months.  We will continue to provide updates as they develop.

As a reminder, for any members that are receiving a Skelly packet regarding the vaccine mandate, please reach out to UFLAC for representation.
